Giorgos Papantoniou & Co LLC, a Nicosia based Law firm, having its registered address at 41 Themistokli Dervi, Hawai Tower, Office 405, Nicosia, 1066, Cyprus, with the registration number HE 263134, (hereinafter referred to as «the Law Firm» or “we” or “our” or “us”) is committed to protecting your privacy by our compliance with applicable European and Cyprus data protection laws and regulations in force and ensuring you have a constructive experience while visiting our Law Firm’s Website or entrust to you your personal data.

The Law Firm is the controller of your personal data obtained by us either from the website www.papantoniou-law.com (otherwise it may be hereinafter referred to as “our website”) or which was provided by you to us directly or which was communicated to use in the course of our activities associated with a legal profession.

The “Regulation (EU) 2016/679 of the European Parliament and of the Council of 27th April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), (hereinafter referred to as “GDPR”), provides that

“ ‘personal data’ means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;”

3. What personal Data we collect  (from you or provided to us by you )

We collect Personal Data as follows:

  • When you (or your employees, or representatives or associates or otherwise) voluntarily disclose it to us. This may include personal data which was sent for the purposes of assessment of our cooperation, engagement our Law Firm, provision of requested services by our Law Firm, subscribing to our news, etc,
  • When third parties disclose it to us for the purposes of provision of the services you requested,
  • When you visit our website by placement of cookies on your PC, if your specifically agree to it while visiting our website www.papantoniou-law.com,
  • Due to the nature of our professional activity, we may also be entrusted with a personal data of third persons necessary for provision of our services to a client.
  • Records of your correspondence with us and any other documents you disclosed to us.

We acknowledge that such information is of highest confidentiality level, and will take all appropriate technical and other measures for its protection.

We use your Personal data including Sensitive data about you or provided to us by you only to the extent necessary to fulfil the below mentioned purposes and serving your best interests.

Purposes for use of Personal/Sensitive Data:

  • Identify you as a person,
  • Process your requests, including provision to you information about our services,
  • For the performance of a contract between you and our Law Firm or the implementation of pre-contractual measures taken at your request;
  • To manage your case including negotiations, communications, consultations, offers acceptance and placement, receiving of payments, settlements or other processing emanating from the nature of your case,
  • Appropriate and smooth performance of services to you,
  • Offer information or services including employment opportunities to you, (if you gave to us explicit consent to do so. You always will have the option to unsubscribe from receiving such communication),
  • If the processing is necessary for the performance of a task carried out in the public interest or in the exercise of our legal obligation vested to us by the EU/Cyprus legislation including notification and reporting to government offices, their auxiliary organizations or other organizations to which the Law Firm belongs
  • Provision of information and communications relating to hiring by the Law Firm, screening of job applicants and hiring decisions,
  • For the purposes of ensuring of our Law Firm’s network and information security,
  • Communications during emergencies
  • In order to implement measures effective to facilitate the relationship between the Law Firms and you.
  • We may share some of/ all of your Personal Data with our officers and/or employees for the best provision of our services to you, depending on necessity in each case.
  • For the functionality and security reasons, such as to detect, prevent and respond to actual or potential fraud, illegal activities and intellectual property infringements.
  • For any other purpose, not mentioned herein, provided that a separate consent is obtained from you.

We acknowledge our duty to process Personal/Sensitive data strictly necessary for the purposes it is collected and if it cannot be fulfilled by other means.

Subject to the necessary extent and for the purposes of:

  • fulfillment of our respective obligations towards you,
  • preparation of statistical, analytical, marketing data,

  • prevention of illegal activities or protection of our legal interests purposes

  • a monitoring, inspection or regulatory function connected, even occasionally, to the exercise of official authority;
  • the protection of the data subject or the rights and freedoms of others;
  • the enforcement of civil law claims.

Our Law Firm is permitted to use your Personal Data  :

  • To investigate, prevent, report or take action regarding illegal activity, suspected fraud, or other wrongdoing;
  • To protect and defend the rights, property or safety of our company or our website, our customers, our employees, or others;
  • To comply with our legal obligations to which we are subject by EU /Cyprus legislation;

 

In any case the priority for us is to keep your Personal Data as confidential as possible.

The Company hereby warrants that it endeavors to keep confidential the Personal Data by using appropriate safeguards and other technical protection.

 

4.3 Territorial use (transfer to third countries)

Depending on your own needs and request, your Personal Information can be transferred to various jurisdictions (either within EU or outside of EU) whether or not by automatic means. Some of countries do not maintain the same level of protection. Transfer to such countries will be made provided that:

  • we have your explicit consent to such transfer, or
  • the transfer is necessary for the conclusion or performance of a contract concluded in your interests between our Law Firm and another natural or legal person, or
  • the transfer is necessary for the performance of a contract between us or the implementation of pre-contractual measures taken at your request;
  • the transfer is necessary in order to protect your vital interests or the vital interests of other persons, you physically or legally incapable of giving consent;

5. Where Personal Data is stored

Personal data which is controlled by our Law Firm is stored and maintained in Cyprus. 

6. Retention of personal data

Your personal information will be stored during the period of cooperation between us.

After the end of our cooperation or interaction, your personal information will be archived and kept either for 6 years or as long as it is necessary for our compliance with a respective obligations which are is subject to applicable legislation of EU and Cyprus, (such as storage requirement, book-keeping rules etc.), whichever comes first.

Information collected for advertising or marketing purposes will be stored for a period of 12 months.

After expiration of the above periods, the personal information will be erased unless we specifically mutually agree to the opposite or a longer period of storage is agreed between us in addition.

Please note, that under GDPR the further retention of the personal data is also lawful where it is necessary, for exercising the right of freedom of expression and information, on the grounds of public interest in the area of public health, for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes, or for the establishment, exercise or defence of legal claims. If such event will occur, we will send to you respective notification.

 

7. Your rights, right to choose, right to access, right to be forgotten

You may request from the Law Office an update what of your Personal Date is kept by the Law Office.

If your data is incorrect, incomplete or irrelevant, you can ask to have the information corrected.

You are kindly requested to keep your personal data accurate and up-to-date by sending to us respective updates.

You may request us to delete/or stop transferring or processing any of or all Personal Data kept about you or Personal Data provided to us by you.

However, once you request so you should be aware that in this case the Law Firm either may not be able to perform some or even all its obligations (depending on the volume of the request) towards you and no liability can be imposed to the Law Firm as result of such request.

We will inform you within 72 hours (if necessary, with the reasoning) whether your request is executed or we will not be able to execute your request as result of our obligations/rights to keep your data.

Also, you will be able to unsubscribe by following respective instructions at the end of each marketing message.

8. Our obligation to notify

In the case of a personal data breach, our Law Firm as the controller shall without undue delay and, where feasible, not later than 72 hours after having become aware of it, notify the personal data breach to the supervisory authority and you personally.

9. Changes to our Privacy Policy

  • We may modify or revise our Privacy Policy from time to time.
  • We will endeavor to notify you about major changes to this Privacy Policy, however, you are expected to periodically review our Privacy Policy which is posted on www.papantoniou-law.com for any updates.
  • In case of any changes, the Privacy Policy will show the date when it was last updated.
  • If date is not changed from your last review of the Privacy Policy, it means it remained unchanged since that day.
